We won this referendum by a solid and democratic majority of listeners and staff---despite Pacifica management’s announcement to the contrary.
Vote Yes-New Day Pacifica will work through the various legal and political channels available to us with your support to appeal and reverse this wrong-headed decision which allows those individuals responsible for Pacifica’s financial and organizational crisis to stay in charge at Pacifica. Pacifica needs to immediately recognize the membership’s decision to approve and implement the New Day Pacifica bylaws proposals so we can save Pacifica and all five radio stations, archives and affiliates.
NDP Bylaws Referendum Results
Pacifica is using a “staff veto” theory to justify declaring that Vote Yes lost. Pacifica posits that since the New Day proposals affect the staff, if the staff reject the proposals the vote of the overall membership is irrelevant and the proposals fail. The irony of Pacifica’s management professing concern for the opinion of Pacifica’s staff while overseeing the gutting of Pacifica staff’s benefits should not be lost on anyone. (Pacifica recently eliminated employer-paid family health insurance at KPFK and is planning to gut existing severance language protections to facilitate laying off long-term staff at KPFK.)
Question: is a "staff veto" of bylaws proposals ever permitted under the Pacifica bylaws and California non-profit law?
Yes, but only in the most extreme circumstances where the bylaws proposals would "materially and adversely affect the rights" of the staff "as to voting or transfer in a manner different than" such action affects the listener-members. (See the Pacifica Bylaws, Article 17, sections 1B-3 and 1B-4). The New Day Pacifica proposals do not "materially and adversely" affect Pacifica staff’s rights, so the membership's majority decision (which includes both listeners and staff) should determine that Vote Yes won the referendum.
Question: doesn't Pacifica staff support Vote Yes-New Day Pacifica?
Yes! Staff at KPFA, KPFK and KPFT overwhelmingly support Vote Yes-New Day Pacifica to save Pacifica, all five stations, the archives and affiliates. Vote Yes-New Day Pacifica also has some staff support at WBAI and WPFW. However, Pacifica management at WBAI (GM and PD) and WPFW (PD) used their positions at Pacifica management to coerce staff into voting No after they publicly endorsed Vote No this year. Last year WBAI management was even caught ordering staff to produce vote No receipts to prove they were loyal staff members!
Question: so how will New Day appeal/overturn the illegal bylaws decision?
New Day yesterday requested arbitration as per our December 4 agreement with Pacifica to use arbitration to resolve election issues to "avoid litigation and expense to the Pacifica Foundation." Even given this agreement, Pacifica has already hired another expensive law firm to prepare for a court fight, clearly hoping to bankrupt New Day Pacifica due to court costs.

We shall continue previous manager Anyel’s prescription for ‘quiet fund drive’ which worked for us last time - though the station didn’t make goal (hence we’re back!) and will avoid program cancellations for straight fundraising. Until the ‘Yes v. No’ voting decision is made we will continue to suggest monthly sustainer donations ($5 to $500 per month) so if Roy and Buzz and “Something’s Happening!’’ disappear, you can easily cease your donation unless of course you are supporting other programs besides the night show. This is not “extortion” as some accusing board members have suggested but simply to honestly avoid a ‘bait and switch’ situation in which you are supporting the show which isn’t there anymore.

The history of the U.S. is one of settler colonialism. The state was established on the basis of white male supremacy, slavery, land theft and genocide. “From sea to shining sea” the Native nations were decimated and dispossessed. The survivors herded into concentration camps. The genocidal policy reached its peak under President Andrew Jackson. Its ruthlessness was best articulated by Army general Thomas Jesup, who, in 1836, wrote: “The country can be rid of them only by exterminating them.” Native people are still here. Today, there is growing support for their movements such as the campaign to abolish Columbus Day and replace
it with Indigenous Peoples’ Day. The Dakota Access Pipeline resistance led by the Standing Rock Sioux was joined by many non-Native allies. The action, though unsuccessful, captured the imagination of people everywhere. The struggle for indigenous rights continues.
Roxanne Dunbar-Ortiz grew up in rural Oklahoma, the daughter of a tenant farmer and part-Indian mother. She has been active in the indigenous movement for more than four decades and is known for her commitment to social justice issues. She is an award-winning scholar and author of such books as An Indigenous Peoples’ History of the United States, All the Real Indians Died Off and Loaded: A Disarming History of the Second Amendment. The fury over racism that has been raging across the nation following the criminal, unnecessary deaths African American citizens by police and deranged White supremacists, is now becoming embedded in corporate boardrooms, legislative assemblies, school and university policymaking, and the left and right media. To an outside observer, it may appear that it is reaching a peak of many diverse disjointed voices, sometimes seemingly incoherent, speaking against and past each other. When issues of race become so polarized within a politicalized social context, the entire message for raising anti-racist awareness becomes lost in the static. But that happens to be the place we find ourselves now. Fortunately, many progressive anti-racial organizations and local movements, such as Black Lives Matter, Color of Change, Live Free USA, Resource Generation, Rainbow Coalition, Equal Justice Initiative, among others, have managed to keep themselves above the cacophony of institutional noise. In the past we have always supported public demonstrations against social injustice in all of its forms and manifestations.
Over the years, in our efforts to share unbiased criticism and constructive solutions into controversies and debates over racism and social and economic inequality, we have recently singled out Robin DiAngelo’s writings and her bestseller White Fragility. We have done so because we find that the deeper underpinnings of her message are fundamentally flawed and put forth an elitist position that theoretically silences any constructive debate about race, even if held on neutral grounds. Attorney David Burke describes the book as “snake oil masquerading as insight.” Moreover, White Fragility is intellectually fragile, impoverished by a lack of convincing facts to buttress her premises and in some cases mangling facts altogether in order to convince Whites of their guilt-ridden birthright. For example, her claim that Congress is 90 percent White hasn’t been true for several decades. Then we find some twisted logic such as “I believe that white progressives cause the most daily damage to people of color. I define a white progressive as any white person who thinks he or she is not racist, or is less racist.”…

Continuing discussion and analysis from FTR#1185, we present discussion of the background and context to Pentagon and USAID funding for research into bat-borne coronaviruses through EcoHealth Alliance, in and around China.
The Pentagon funding for these projects must be seen against the background of three overlapping areas of consideration:
1.–The fact that any virus can be synthesized or modified from scratch. As detailed in a very important article from The Guardian: “ . . . Advances in the area mean that scientists now have the capability to recreate dangerous viruses from scratch; make harmful bacteria more deadly; and modify common microbes so that they churn out lethal toxins once they enter the body. . . In the report, the scientists describe how synthetic biology, which gives researchers precision tools to manipulate living organisms, ‘enhances and expands’ opportunities to create bioweapons. . . . Today, the genetic code of almost any mammalian virus can be found online and synthesised. ‘The technology to do this is available now,’ said [Michael] “It requires some expertise, but it’s something that’s relatively easy to do, and that is why it tops the list. . . .”
2.–Also fundamental to an understanding of the Covid “op” is the devastating nature of bat-borne viruses when introduced into the human body. “ . . . . As Boston University microbiologist Thomas Kepler explained to the Washington Post in 2018, the bat’s unique approach to viral infection explains why viruses that transfer from bats to humans are so severe. . . . ‘A virus that has co-evolved with the bat’s antiviral system is completely out of its element in the human,’ Kepler said. ‘That’s why it is so deadly — the human immune system is overwhelmed by the inflammatory response.’ The bat immune system responds very differently from ours to viral infection. Instead of attacking and killing an infected cell, which leads to a cascade of inflammatory responses, the bat immune system can starve the virus by turning down cellular metabolism. The bat origin of SARS-CoV‑2 may explain the cytokine storms that are hastening some COVID-19 deaths. . . .”
3.–Analysis presented in the liberal New York Magazine by Nicholson Baker takes stock of the implications of contemporary biotechnology and what we have termed (in past broadcasts) “The Magic Virus Theory.” “. . . . SARS‑2 seems almost perfectly calibrated to grab and ransack our breathing cells and choke the life out of them. . . . Perhaps viral nature hit a bull’s‑eye of airborne infectivity, with almost no mutational drift, no period of accommodation and adjustment, or perhaps some lab worker somewhere, inspired by Baric’s work with human airway tissue, took a spike protein that was specially groomed to colonize and thrive deep in the ciliated, mucosal tunnels of our inner core and cloned it onto some existing viral bat backbone. It could have happened in Wuhan, but — because anyone can now ‘print out’ a fully infectious clone of any sequenced disease — it could also have happened at Fort Detrick, or in Texas, or in Italy, or in Rotterdam, or in Wisconsin, or in some other citadel of coronaviral inquiry.. . .”
Taken together and in the context of the full-court press against China discussed in many programs including FTR#’s 1089, 1090, 1091, 1092, 1103, 1143, 1144, 1145, 1178, 1179, 1180, the Pentagon/USAID funding of EcoHealth Alliance and the research into bat-borne coronaviruses being conducted at the WIV and elsewhere in and around China, the three considerations just enumerated point ominously to the Covid-19 pandemic as an “op.”
