For the Record with David Emory #1325
In his first new episode after a hiatus, Dave returns to legal "Chokeholds" in the JFK assassination with a two-part interview, FTR 1325 and 1326. These programs continue the presentation of the legal concept of “Chokeholds” on the JFK assassination–dynamics that prove, legally, that there was a conspiracy.
These do not necessarily resonate precisely with aspects of the historical record, which embraces, but does not delineate, principles of law.
In these broadcasts, Jim DiEugenio, Paul Bleau and Mr. Emory are joined by Matt Crumpton, one of the contributors to the book, a lawyer and author of a brilliant chapter of the volume dealing with the Oswald impersonators.
We conclude the first broadcast with a tribute to the recently-deceased Cyril Wecht and Dr. William F. Pepper (who proved in court a conspiracy in the assassination of Martin Luther King Jr.).

KPFK is starting our summer on air membership and funding drive, and we're going to be asking you to step up on behalf of Something's Happening, to help keep this program and this station on the air. The Foundation determined that it needed to sell the building that housed KPFK and the Pacifica Radio Archives in order to cover accumulated debt and "aged payables," overdue unpaid bills, which necessitated that KPFK move. We have had to cover the expenses of the move, which were supposed to come from the proceeds of the sale, but the close of escrow has been delayed and we must continue to cover those expenses including rent for the new location, from current revenues. This on-air drive is critical to doing so.

Yet for as long as anyone can remember, the Constitution has occupied a quasi-mythical status in US political culture, which ties ideals of liberty and equality to assumptions about the inherent goodness of the text’s design. The Constitutional Bind explores how a flawed document came to be so glorified and how this has impacted life in the US.
In a path-breaking retelling of the "American experience", Aziz Rana shows that today’s reverential constitutional culture is a distinctively 20th-century phenomenon. Rana connects this widespread idolization to another relatively recent development: the rise of US global dominance. Ultimately, such veneration has had far-reaching consequences: despite offering a unifying language of reform, it has also unleashed an interventionist national security state abroad while undermining the possibility of deeper change at home.
Revealing how the current constitutional order was forged over the twentieth century, The Constitutional Bind also sheds light on an array of movement activists—in Black, Indigenous, feminist, labor, and immigrant politics—who struggled to imagine different constitutional horizons. Mickey's first guest is historian Peter Kuznick, who evaluates some of the conflicts taking place in the world (Ukraine, Middle East, South China Sea),
and finds a common thread in the abandonment of diplomacy by U.S. officials and some of their European allies. And he warns of the increasing danger that one of these conflicts (especially Ukraine) could escalate into a nuclear war.
Then press-freedom advocate Seth Stern returns to the show to explain the PRESS Act, a reporter-shield bill that has already passed the House unanimously and is awaiting action in the Senate. If enacted, it would protect journalists from being compelled to disclose confidential sources. Stern explains the details of the legislation, and cites cases of why it's needed.

In the first segment, Amelia Bonow tells Eleanor how, owing to a welter of state restrictions and conditions, abortion has always been difficult to access for millions of women in the U.S, even before the before the Supreme Court's reversal of its 1973 Roe vs Wade decision: "Roe vs. Wade was never enough." Since the reversal, many states have outlawed all or nearly all abortions. But Bonow says changing attitudes, and the near-universal availability of abortion pills, mean that choice is still possible despite repressive state laws.
In the second half of the show, Kevin Gosztola returns to the program to tell Mickey the latest about the Julian Assange case: a recent ruling by the UK High Court of Justice that could complicate or even halt the Biden Administration's efforts to extradite Assange. Kevin and Mickey also take note of new attacks on press freedom and whistleblower rights taking place in the U.S., Israel, and Australia.

Dave says he will be producing new programs again soon, and recommends we air this archival episode for the upcoming Memorial Day holiday next Monday. Reprising the first of the Archive Shows (originally recorded on 5/23/1980), this program examines the corporate relationships between German and American firms that were instrumental in the rise of the Third Reich. "Uncle Sam and the Swastika: U.S Industrial Support for Nazi Germany” contains insights that are even more relevant and more frightening than they were in 1980. As the 25th anniversary of the original broadcast passed, Mr. Emory re-broadcast the show, with editorial comment before and after its playing. In particular, Mr. Emory noted the hauntingly contemporary insights that author James Stewart Martin imparted at the conclusion of his landmark text All Honorable Men. Mr. Martin warned that the American component of the trans-Atlantic fraternity that had funded and armed Hitler might chose to bring fascism to America “as a calm judgment of business necessity.”

Queers Protest LGBTQ Advocacy Group's Collaboration with Pro-Israel Propaganda Organization
GLAAD Media Awards Protest
OutFM presents voices from the protest of the Gaza genocide last Saturday during the annual Media Awards ceremony of one of the largest, best-funded LGBTQ defense organizations, the Gay & Lesbian Alliance Against Defamation or GLAAD. GLAAD is a 40-year-old media watchdog against negative representations of queer and trans people.
The 150-strong rally outside the New York City Hilton Hotel was sponsored by the AIDS Coalition to Unleash Power or ACT UP, and Jewish Voice for Peace. It demanded the severing of GLAADs joint work with the Anti-Defamation League or ADL, which decided last fall to add ALL Palestine solidarity events to its tallies of anti-semitic incidents. The ADL also brings U.S. police to Israel to be trained in crowd control by high-level military personnel.

The farm sits on land owned by the public Housing Authority of the City of Asheville (HACA) and there is currently a threat that HACA will destroy the farm. For the hour we talk about the work of the farm, the legacy of a community farm in the wake of government policies that destroy Black communities, and ways that community members can support the SCF and help it thrive.

GLAAD Media Awards Protest
OutFM presents voices from the protest of the Gaza genocide last Saturday during the annual Media Awards ceremony of one of the largest, best-funded LGBTQ defense organizations, the Gay & Lesbian Alliance Against Defamation or GLAAD. GLAAD is a 40-year-old media watchdog against negative representations of queer and trans people.
The 150-strong rally outside the New York City Hilton Hotel was sponsored by the AIDS Coalition to Unleash Power or ACT UP, and Jewish Voice for Peace. It demanded the severing of GLAADs joint work with the Anti-Defamation League or ADL, which decided last fall to add ALL Palestine solidarity events to its tallies of anti-semitic incidents. The ADL also brings U.S. police to Israel to be trained in crowd control by high-level military personnel.
Margaret Rhee is an assistant professor at the New School who has also taught at SUNY Buffalo and UCLA; Pauline Park speaks with the published poet, scholar and new media artist about queer Korean American and Asian American identity and her innovative work at the intersection of queer, feminist and ethnic studies, getting her thoughts about robots and her queering of robotics.

We sat down with three local activists to talk about the proposed Asheville (North Carolina) Business Improvement District, a model of service provision using public funding to increase policing in downtown by an unelected and unaccountable body of largely business and property owners. For the hour, Grace, Madison and Elliot talk about attempts to ram the BID through public process, some of the businesses and individuals behind it, how bids have panned out in other cities around the country and what space there is left to oppose this further privatization of public space in Asheville. We didn't mention it here, but there have also been rumblings of the BID model, a version of which was fought and never funded in 2012, being applied to other parts of Asheville, for example West Asheville. This is our show for the week of May 12th.
As a quick note, there are a few acronyms frequently used in this conversation. One is RFP, which stands for Request for Proposals and is a process of contracting out an element of a project. Another acronym is ADA, in this case Asheville Downtown Association which is an independent pressure group made up of individuals, business and property owners. Not to be confused with the Asheville Downtown Commission, which was created by the City Council and contains appointed representatives from the ADA, city council, Buncombe County Board of Commissioners and few other community members including business owners.
Curator's note: This will sound quite familiar to listeners in Los Angeles, where the Central City Association Business Improvement District (BID) hires its own private security on bikes to police DTLA and Skid Row to supplement the LAPD, and public-private partnerships involving non-profits associated with individual city councilmembers ally with BIDs and city agencies to shape public spaces and resources in alignment with private developers' needs and desires.

Queer Campus Activists Against Gaza Genocide
On the afternoon of May 1, SUNY New Paltz students began a peaceful encampment to urge the SUNY New Paltz administration to stop financially supporting companies that contribute to israeli apartheid. 36 hours later, over 50 state troopers entered campus and began violently arresting students. Queer students and faculty from schools in New York and California describe their experience of intimidation, suppression and violence as they support Palestinians. They challenge the way their colleges collude with the Zionist system of persecution and mass murder. They themselves are punished for fighting for Palestinian liberation.
Google Fires Anti-Apartheid Workers
In mid-April, Google abruptly terminated at least 50 workers for protesting Project Nimbus which has made the tech giant complicit in Apartheid Israel's Gaza genocide " though the organizers insist that some of the workers who were fired were simply observing the demonstration; on Tuesday's show, two of the terminated ex-Googlers will talk about the #NoTechForApartheid campaign and their legal challenge to Google's unfair labor practices.

The Treasury would not bear the burden of proof. HR6408 has already passed the House, and the parallel measure S4136 is pending in the Senate. Mickey's guests warn that if enacted, the measures are likely to be used to undermine media outlets that espouse views contrary to administration policies, especially on Palestine.
